Forms relating to Obtaining Protected Information

  1. The Registrar of Companies has specified three forms for use for the purposes of section 58(3) of the Companies Ordinance (Chapter 622).  Two forms have also been introduced for opening of Special Accounts by designated types of specified persons and their authorised representatives for the purpose of applying for disclosure of Protected Information. 
     
    The forms relating to obtaining Protected Information can be used starting from 24 October 2022, the commencement date of Phase 2 of the New Inspection Regime.

  1. Purpose of Collection

    1. Personal data provided by the Applicant to the Registrar in this application will be used by the Registrar for one or more of the following purposes:

      1. to administer the CO, the Companies (Winding Up and Miscellaneous Provisions) Ordinance (Cap. 32) ("CWUMPO") and those provisions (if any) of the Companies Ordinance (Cap. 32) as in force before the commencement of the CO ("Predecessor CO") that have been repealed but are still having continuing effect;
      2. to enforce relevant provisions of the CO, the CWUMPO and those provisions (if any) of the Predecessor CO that have been repealed but are still having continuing effect; and
      3. to carry out the Registry’s functions relating to the provision of services by the Registry.
    2. Provision of the personal data in this application is voluntary. If the personal data are not provided, the Registry will not be able to process this application.

    Classes of Transferees
    The personal data provided by the Applicant may be disclosed or transferred to relevant parties where such disclosure or transfer is necessary for the purposes as stated in paragraph 1 above. Such personal data may also be disclosed or transferred to law enforcement agencies as permitted under the Personal Data (Privacy) Ordinance (Cap. 486) ("PDPO").

    Notice

    Individuals have a right to request access to and correction of his/her personal data held by the Registry pursuant to sections 18 and 22 of the PDPO. Any such request for access to and correction of such personal data may be made to any officer acting for or on behalf of the Registrar at the Companies Registry, 15th Floor, Queensway Government Offices, 66 Queensway, Hong Kong.

    Personal Data (Privacy) Ordinance (Cap. 486)

    The provisions of the PDPO apply to the use of personal data obtained from the Companies Register. Any person who uses personal data for any purpose other than the purposes for which the data are made available pursuant to section 58(3) of the CO or in contravention of the requirements under the PDPO is liable to pay compensation and may be subject to enforcement action under the PDPO.
