In December 2015, a director of each of the companies, namely, YST Technology Limited (CR No. : 988813), YST Telecommunication Limited (CR No. : 1237894) and Unitek Holdings Limited (CR No. : 961277), was prosecuted by the Companies Registry and convicted for 12 counts of charges at the Eastern Magistrates’ Courts (i) under section 109(1A) of the predecessor Companies Ordinance (i.e. the Companies Ordinance, Cap. 32, as in force before the commencement of the Companies Ordinance, Cap. 622) for the companies’ failure to file the annual returns of the companies for the years 2012 and 2013, and under section 662(1) of the Companies Ordinance, Cap. 622 ("the Ordinance") for the companies’ failure to file the annual returns of the companies for the year 2014; and (ii) under section 658(1) of the Ordinance for the companies’ failure to have a registered office in Hong Kong. A total fine of $60,000 was imposed by the Court.
